Se n\u00e3o for poss\u00edvel chegar a acordo sobre a mudan\u00e7a, ter\u00e1 de requerer ao tribunal uma ordem que lhe conceda autoriza\u00e7\u00e3o para se mudar com a crian\u00e7a. Esta a\u00e7\u00e3o \u00e9 conhecida como \u201cautoriza\u00e7\u00e3o de mudan\u00e7a\u201d. Aplicam-se regras e considera\u00e7\u00f5es diferentes consoante a mudan\u00e7a proposta seja interna (dentro de Inglaterra e do Pa\u00eds de Gales) ou externa (fora da jurisdi\u00e7\u00e3o), mas a abordagem do tribunal para decidir estes pedidos \u00e9, em termos gerais, a mesma e centrar-se-\u00e1 no interesse superior da crian\u00e7a. A lista de controlo inclui:<br\/><br\/>- Os desejos e sentimentos da crian\u00e7a em causa, na medida em que possam ser verificados, e tendo em conta a sua idade e compreens\u00e3o;<br\/>- As necessidades f\u00edsicas, emocionais e educativas da crian\u00e7a;<br\/>- O efeito prov\u00e1vel sobre a crian\u00e7a de qualquer altera\u00e7\u00e3o da sua situa\u00e7\u00e3o;<br\/>- A idade, o sexo, os antecedentes e as carater\u00edsticas relevantes da crian\u00e7a;<br\/>- O risco de a crian\u00e7a sofrer danos; e<br\/>- A capacidade de cada um dos pais para satisfazer as necessidades da crian\u00e7a.<br\/><br\/>O juiz analisar\u00e1 a forma como a autoriza\u00e7\u00e3o ou a recusa de relocaliza\u00e7\u00e3o afectar\u00e1 os pais e a crian\u00e7a, e considerar\u00e1 os planos dos pais e se o desejo de relocaliza\u00e7\u00e3o e a oposi\u00e7\u00e3o \u00e0 mesma s\u00e3o genu\u00ednos. The judge has to consider a checklist of things before coming to a decision (this is called the \u2018welfare checklist\u2019). The checklist includes:<br\\\/><br\\\/>\u2022 The wishes and feelings of the child concerned so far as they can be ascertained, and bearing in mind the child\u2019s age and understanding;<br\\\/>\u2022 The child\u2019s physical, emotional and educational needs;<br\\\/>\u2022 The likely effect on the child of any change in their circumstances;<br\\\/>\u2022 The child\u2019s age, sex, background and relevant characteristics;<br\\\/>\u2022 The risk of the child suffering harm; and<br\\\/>\u2022 How capable each parent is of meeting the child\u2019s needs.<br\\\/><br\\\/>The judge will consider how permission or refusal to relocate will affect the parents and the child, and will consider the parents\u2019 plans and whether the wish to relocate and opposition to it are genuine. The judge may well be assisted in reaching a conclusion by a Children and family reporter from the Children and Family Court Advisory and Support Service (Cafcass) or by a report from an independent social worker. It is often difficult to predict the outcome of court proceedings for leave to remove, and it is usually advisable to at least try and resolve disputes about where a child lives through mediation or
