L'enfant avait \u00e9t\u00e9 ill\u00e9galement retenu en Angleterre par son p\u00e8re \u00e0 la suite de vacances convenues, et la m\u00e8re avait demand\u00e9 un retour sommaire en vertu des dispositions de la convention de La Haye de 1980. Il a \u00e9t\u00e9 admis que l'enfant s'opposait \u00e0 son retour en Roumanie et le juge de la High Court a exerc\u00e9 son pouvoir discr\u00e9tionnaire pour ne pas rendre d'ordonnance de retour en premi\u00e8re instance.<\/p>\n\n\n\n<p>L'appel a \u00e9t\u00e9 accueilli et la Cour d'appel a ordonn\u00e9 le retour imm\u00e9diat de l'enfant.
