Ces ordonnances d\u00e9terminent avec qui l'enfant doit vivre ou passer du temps.<\/p>\n<p><strong>Qui peut demander une ordonnance d'arrangement concernant les enfants ?<\/strong><\/p>\n<p>Une demande de Child Arrangements Order peut \u00eatre introduite par l'une des personnes suivantes sans l'autorisation du tribunal :<\/p>\n<ul>\n<li>Un parent<\/li>\n<li>Un gardien<\/li>\n<li>Les tuteurs sp\u00e9ciaux<\/li>\n<li>Une personne dans le cadre d'un mariage ou d'un partenariat civil lorsque l'enfant est un enfant de la famille<\/li>\n<li>Toute personne exer\u00e7ant la responsabilit\u00e9 parentale \u00e0 l'\u00e9gard de l'enfant<\/li>\n<li>Toute personne ayant v\u00e9cu avec l'enfant pendant trois ans ou plus<\/li>\n<\/ul>\n<p>Si une autre personne, qui ne figure pas dans la liste ci-dessus, souhaite d\u00e9poser une demande d'ordonnance sur les arrangements concernant les enfants, elle doit d'abord demander au tribunal l'autorisation de d\u00e9poser sa demande.<\/p>\n<p><strong>Comment demander une ordonnance sur les arrangements concernant les enfants ?<\/strong><\/p>\n<p>La toute premi\u00e8re \u00e9tape, avant qu'une demande ne soit introduite aupr\u00e8s du tribunal, consiste pour les parties \u00e0 assister \u00e0 un MIAM. Un MIAM est une r\u00e9union de m\u00e9diation au cours de laquelle un m\u00e9diateur rencontre les parties afin d'\u00e9valuer si leur diff\u00e9rend peut \u00eatre r\u00e9solu par la m\u00e9diation.<\/p>\n<p>Si le m\u00e9diateur estime que le litige peut \u00eatre r\u00e9solu par la m\u00e9diation, il organise une s\u00e9ance de m\u00e9diation avec les parties. Si, en revanche, le m\u00e9diateur estime que l'affaire ne se pr\u00eate pas \u00e0 la m\u00e9diation, il signera un formulaire le confirmant, qui devra \u00eatre joint \u00e0 toute demande adress\u00e9e au tribunal.<\/p>\n<p>Il existe des exceptions pour lesquelles la m\u00e9diation n'est pas n\u00e9cessaire, par exemple lorsque l'une des parties a \u00e9t\u00e9 victime de violences domestiques.<\/p>\n<p>Une fois que les parties ont assist\u00e9 \u00e0 un MIAM ou qu'elles ont \u00e9tabli qu'il existe une exemption, l'\u00e9tape suivante consiste \u00e0 introduire une demande aupr\u00e8s du tribunal au moyen d'un formulaire C100. Ce formulaire peut \u00eatre obtenu en ligne ou aupr\u00e8s d'un greffe.<\/p>\n<p>Une fois que le greffe du tribunal a d\u00e9livr\u00e9 la demande, la premi\u00e8re audience est fix\u00e9e.  Cette premi\u00e8re audience est connue sous le nom de FHDRA (First Hearing Directions Resolution Appointment). Lors de cette audience, le tribunal demandera des informations ou des documents n\u00e9cessaires \u00e0 la r\u00e9solution de l'affaire. Il peut s'agir, entre autres, des d\u00e9clarations des t\u00e9moins des parties ou d'un rapport d'aide sociale \u00e9tabli par un agent du Children and Family Court Advisory and Support Service (CAFCASS). Le tribunal fixera \u00e9galement une nouvelle audience \u00e0 ce moment-l\u00e0.<\/p>\n<p>L'audience suivante est un rendez-vous de r\u00e9solution des litiges (DRA). Lors de cette audience, le tribunal examinera tous les \u00e9l\u00e9ments de preuve et tentera de travailler avec les parties pour parvenir \u00e0 un accord. Si un accord ne peut \u00eatre trouv\u00e9, le tribunal inscrit l'affaire au r\u00f4le pour une audience finale, au cours de laquelle le tribunal rendra une ordonnance d\u00e9finitive.<\/p>\n<p><strong>Quelle est la dur\u00e9e de validit\u00e9 d'une ordonnance de placement d'enfants ?<\/strong><\/p>\n<p>Conform\u00e9ment \u00e0 l'article 91(10) de la loi sur les enfants de 1989 (Children Act 1989), une ordonnance d'arrangement concernant la personne avec laquelle un enfant doit passer du temps restera en vigueur jusqu'\u00e0 ce que l'enfant concern\u00e9 atteigne l'\u00e2ge de 16 ans.<\/p>\n<p>Une ordonnance d'arrangement concernant la personne avec laquelle l'enfant doit vivre (anciennement appel\u00e9e \u201cgarde\u201d) reste en vigueur jusqu'\u00e0 ce que l'enfant concern\u00e9 atteigne l'\u00e2ge de 18 ans.
