{"id":13208,"date":"2019-01-31T16:16:25","date_gmt":"2019-01-31T16:16:25","guid":{"rendered":"https:\/\/goodmanray.com\/?p=13208"},"modified":"2025-02-07T10:51:29","modified_gmt":"2025-02-07T10:51:29","slug":"landmark-draft-domestic-abuse-bill-published","status":"publish","type":"post","link":"https:\/\/www.goodmanray.com\/fr\/news\/2019\/01\/landmark-draft-domestic-abuse-bill-published\/","title":{"rendered":"Publication d'un projet de loi historique sur les violences domestiques"},"content":{"rendered":"<p>Le gouvernement a publi\u00e9 un projet de loi sur les violences domestiques qui vise \u00e0 mieux soutenir les victimes de violences domestiques et \u00e0 transformer la r\u00e9ponse du gouvernement aux personnes qui se trouvent dans cette situation.<\/p>\n<p>Le projet de loi donnera pour la premi\u00e8re fois une d\u00e9finition juridique de la violence domestique, en reconnaissant sp\u00e9cifiquement qu'elle va au-del\u00e0 de la violence physique et qu'elle inclut les victimes qui sont victimes d'abus \u00e9conomiques et celles qui sont soumises \u00e0 des abus non physiques contr\u00f4lants et manipulateurs. Cette d\u00e9finition peut inclure des \u00e9l\u00e9ments tels que le fait de refuser \u00e0 un partenaire l'acc\u00e8s \u00e0 son propre compte bancaire ou \u00e0 un compte bancaire commun, ou de l'emp\u00eacher d'aller travailler. Nous esp\u00e9rons que cette nouvelle d\u00e9finition aidera les gens \u00e0 comprendre ce qui constitue un abus et qu'elle encouragera un plus grand nombre de victimes \u00e0 demander de l'aide et \u00e0 signaler les crimes.<\/p>\n<p>Le projet de l\u00e9gislation honore \u00e9galement la promesse d'abolir le contre-interrogatoire des victimes par leurs agresseurs dans les tribunaux de la famille, ce qui, pendant de trop nombreuses ann\u00e9es, a oblig\u00e9 les victimes \u00e0 subir des abus continus de la part de leurs agresseurs pr\u00e9sum\u00e9s dans l'environnement judiciaire.<\/p>\n<p>Le projet de loi soumis aux d\u00e9put\u00e9s comprendra \u00e9galement les \u00e9l\u00e9ments suivants :<\/p>\n<ul>\n<li>Introduire l'\u00e9ligibilit\u00e9 automatique et l'acc\u00e8s aux mesures sp\u00e9ciales pour les victimes qui t\u00e9moignent devant les tribunaux p\u00e9naux (par exemple, t\u00e9moigner par liaison vid\u00e9o plut\u00f4t que d'\u00eatre dans la m\u00eame pi\u00e8ce que l'agresseur pr\u00e9sum\u00e9).<\/li>\n<li>Cr\u00e9er le poste de commissaire aux violences domestiques, charg\u00e9 de r\u00e9glementer et de superviser la r\u00e9ponse aux probl\u00e8mes de violences domestiques.<\/li>\n<li>Pr\u00e9voir un nouvel avis de protection contre les violences domestiques et une nouvelle ordonnance de protection contre les violences domestiques
