Nous \u00e9coutons pour r\u00e9pondre\u201d.<\/a><\/em><\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Cette phrase m'a frapp\u00e9 car elle r\u00e9sume l'\u00e9tat d'esprit n\u00e9cessaire pour tirer le meilleur parti du processus de m\u00e9diation. Si un couple, des parents ou des conjoints finissent par devoir s'adresser au tribunal pour r\u00e9soudre un conflit familial, ils courent en fin de compte le risque de perdre le contr\u00f4le de leur capacit\u00e9 \u00e0 ma\u00eetriser l'issue de leur conflit. Au lieu de cela, ils remettent la d\u00e9cision entre les mains d'un juge ou d'un arbitre. S'ils sont pr\u00eats \u00e0 discuter de leurs probl\u00e8mes dans le cadre d'une m\u00e9diation, ils conservent le pouvoir de choisir une solution qui leur convienne \u00e0 tous les deux.<\/p>\n<p style=\"text-align: justify;\">C'est bien beau, en principe, d'avoir la possibilit\u00e9 de contr\u00f4ler l'issue de votre m\u00e9diation, et peut-\u00eatre m\u00eame d'arriver \u00e0 une position o\u00f9 ce qui est convenu va au-del\u00e0 de ce qu'un tribunal pourrait faire, mais comment cela se produit-il ? D'apr\u00e8s mon exp\u00e9rience, cela se produit lorsque les individus atteignent un stade du processus de m\u00e9diation o\u00f9 non seulement ils \u00e9coutent le point de vue de l'autre personne, mais o\u00f9 ils essaient \u00e9galement de comprendre pourquoi ils ont une opinion particuli\u00e8re et ce qui motive leur position sur les questions familiales.<\/p>\n<p style=\"text-align: justify;\">\u00c0 un niveau tr\u00e8s \u00e9l\u00e9mentaire, le fait de chercher \u00e0 comprendre l'autre personne diff\u00e8re de l'approche de la proc\u00e9dure judiciaire. Lors d'une audience finale, votre priorit\u00e9 est de pr\u00e9senter au juge un dossier aussi solide que possible. Pour ce faire, vous devez vous assurer que vous avez fourni une r\u00e9ponse claire et r\u00e9fl\u00e9chie aux arguments de l'autre personne. La m\u00e9diation doit in\u00e9vitablement impliquer un compromis \u00e0 un moment ou \u00e0 un autre, souvent de la part des deux parties. Il ne suffit pas de r\u00e9pondre \u00e0 l'opinion ou aux commentaires de l'autre personne pour y parvenir.<\/p>\n<p style=\"text-align: justify;\">Les individus n'entrent pas n\u00e9cessairement dans le processus de m\u00e9diation au stade o\u00f9 ils essaient de comprendre la position de l'autre personne. En fait, une personne peut m\u00eame ne pas avoir l'impression que l'autre l'\u00e9coute. De nombreuses personnes arrivent en m\u00e9diation sans s'\u00eatre parl\u00e9 depuis leur s\u00e9paration. Elles communiqueront cependant pendant la m\u00e9diation et, le plus souvent, commenceront \u00e0 essayer de comprendre les points de vue et les opinions de l'autre personne afin de trouver un terrain d'entente.<\/p>\n<p style=\"text-align: justify;\">La discussion des questions relatives aux enfants dans le cadre de la m\u00e9diation en est souvent un parfait exemple. La position des deux parents, qui tentent de trouver les bonnes dispositions pour leurs enfants, est presque toujours fond\u00e9e sur ce qu'ils estiment \u00eatre l'int\u00e9r\u00eat sup\u00e9rieur de leurs enfants. Il se trouve cependant qu'ils ne sont pas d'accord sur ce qui est le mieux pour leurs enfants. Cela ne signifie pas que les points de vue des uns et des autres sont moins justifi\u00e9s, mais cela signifie que s'ils veulent trouver ensemble une solution qui fonctionne pour leurs enfants, ils devront non seulement s'\u00e9couter l'un l'autre, mais aussi essayer de comprendre le point de vue de chacun. S'ils se contentent d'\u00e9couter pour r\u00e9pondre et exposer leur point de vue, ils ne peuvent pas trouver de compromis ni savoir pourquoi il est n\u00e9cessaire. S'ils \u00e9coutent pour essayer de comprendre les motivations des uns et des autres, ils pourront mieux comprendre quelles sont les priorit\u00e9s de chacun pour les enfants et pourquoi ils ont des opinions aussi tranch\u00e9es sur leur avenir.<\/p>\n<p style=\"text-align: justify;\">Que vous essayiez de trouver une solution pour r\u00e9soudre les probl\u00e8mes qui vous opposent par la n\u00e9gociation, la m\u00e9diation, la collaboration, l'arbitrage ou le contentieux, je vous recommande vivement d'essayer de commencer le processus en \u00e9coutant et en essayant de comprendre le point de vue de l'autre personne, et les raisons pour lesquelles vous vous trouvez dans cette position.
