La acogida puede ser de unas pocas horas o de larga duraci\u00f3n, hasta que el ni\u00f1o alcanza la edad adulta. Antes de convertirse en acogedor, un trabajador social debe realizar una evaluaci\u00f3n.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfQu\u00e9 es la acogida por familiares?<\/h3>\n\n\n\n<p>El acogimiento por familiares es aquel en el que el ni\u00f1o vive con parientes o amigos \u00edntimos de la familia cuando los padres no pueden cuidar de \u00e9l. adopci\u00f3n?<\/strong><\/strong><\/strong> <p class=\"schema-faq-answer\">La principal diferencia es que la adopci\u00f3n transfiere permanentemente la patria potestad de los padres biol\u00f3gicos a los adoptivos.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1737566418801\"><strong class=\"schema-faq-question\"><strong>\u00bfQu\u00e9 responsabilidades legales tienen los acogedores?<\/strong><\/strong> <p class=\"schema-faq-answer\">Los acogedores son responsables del cuidado diario del ni\u00f1o, pero no tienen la patria potestad sobre \u00e9l. La responsabilidad parental sigue correspondiendo a los padres biol\u00f3gicos del ni\u00f1o, y a veces se comparte con la autoridad local en funci\u00f3n de las \u00f3rdenes judiciales vigentes, si las hay.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1737566429062\"><strong class=\"schema-faq-question\"><strong>\u00bfQu\u00e9 es el relevo?<\/strong><\/strong> <p class=\"schema-faq-answer\">Un acogedor de respiro cuidar\u00e1 temporalmente a ni\u00f1os acogidos o con discapacidades cuando sus padres de acogida o biol\u00f3gicos necesiten tiempo para s\u00ed mismos. Suele ser un periodo corto, de uno o dos d\u00edas a una semana.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1737566437626\"><strong class=\"schema-faq-question\"><strong>\u00bfPueden recibir ayuda econ\u00f3mica los cuidadores familiares?<\/strong><\/strong> <p class=\"schema-faq-answer\">S\u00ed, los cuidadores familiares pueden recibir ayuda econ\u00f3mica de las autoridades locales, de forma similar a los cuidadores de acogida, y tambi\u00e9n pueden acceder a asesoramiento jur\u00eddico y recursos que les ayuden con las responsabilidades del cuidado, dependiendo de la naturaleza del acuerdo. Tambi\u00e9n pueden solicitar prestaciones por el menor.<br\/><br\/>Los servicios de menores deben evaluar la necesidad de servicios de apoyo, incluida la ayuda econ\u00f3mica, si un ni\u00f1o estaba bajo la tutela del sistema de acogida inmediatamente antes de que se dictara o se vaya a dictar una orden de tutela especial.  Si no es el caso, la evaluaci\u00f3n de la necesidad de servicios de apoyo para la tutela especial es discrecional.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1737566450123\"><strong class=\"schema-faq-question\"><strong>\u00bfQu\u00e9 es una orden de tutela especial?<\/strong><\/strong> <p class=\"schema-faq-answer\">Se pueden dictar \u00f3rdenes de tutela especial a favor de alguien que no sea su progenitor, para asegurar su hogar a largo plazo hasta que cumpla 18 a\u00f1os. La orden otorga a los tutores especiales una mayor responsabilidad parental sobre el menor, aunque deben seguir consultando con sus padres las decisiones importantes para la vida del menor. Existen algunas restricciones, por ejemplo, un tutor especial no puede cambiar el apellido de un ni\u00f1o ni sacarlo del pa\u00eds durante m\u00e1s de tres meses, a menos que obtenga el consentimiento por escrito de todas las personas con responsabilidad parental. Los tutores especiales pueden tener derecho a una asignaci\u00f3n, que se eval\u00faa en funci\u00f3n de los recursos econ\u00f3micos, as\u00ed como a otras ayudas, seg\u00fan sea necesario.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1737566464196\"><strong class=\"schema-faq-question\"><strong>\u00bfQui\u00e9n puede solicitar ser tutor especial?<\/strong><\/strong> <p class=\"schema-faq-answer\">Cualquier persona que tenga 18 a\u00f1os y no sea el progenitor del menor. Las solicitudes pueden ser individuales o conjuntas.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1737566475974\"><strong class=\"schema-faq-question\"><strong>\u00bfHay que someterse a alguna evaluaci\u00f3n?<\/strong><\/strong> <p class=\"schema-faq-answer\">El tribunal no puede dictar una orden de tutela especial sin una evaluaci\u00f3n por parte de la autoridad local. Suele haber dos fases de evaluaci\u00f3n: una evaluaci\u00f3n de viabilidad es la primera fase, durante la cual un trabajador social le visitar\u00e1 y ver\u00e1 si usted parece capaz de ofrecer cuidados suficientemente buenos a un ni\u00f1o. El resultado de la evaluaci\u00f3n de viabilidad determinar\u00e1 si debe seguir siendo evaluado como tutor especial o como persona vinculada.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1737566484129\"><strong class=\"schema-faq-question\"><strong>\u00bfExiste asistencia jur\u00eddica gratuita para los solicitantes de \u00f3rdenes especiales de tutela?<\/strong><\/strong> <p class=\"schema-faq-answer\">A partir del 1 de mayo de 2023 se ampli\u00f3 el alcance de la asistencia jur\u00eddica gratuita en algunos casos privados de Derecho de familia, tanto para las personas con responsabilidades parentales como para los futuros tutores. La ampliaci\u00f3n se aplica a:<br\/><br\/>- Futuros tutores que presenten solicitudes de \u00f3rdenes especiales de tutela (OEC) en procedimientos privados de Derecho de familia.<br\/>- Cualquier persona con responsabilidades parentales a la hora de responder a las solicitudes de SGO<br\/><br\/>Los cambios significan que, siempre que cumpla los requisitos de elegibilidad financiera, ya no necesitar\u00e1 pruebas.<br\/><\/p> <\/div> <\/div>","protected":false},"excerpt":{"rendered":"<p>Fostering and Kinship Solicitors What is fostering?
