Denegada la asistencia letrada a una superviviente de maltrato dom\u00e9stico por el r\u00e9gimen de convivencia de su hijo<\/h2>\n\n\n\n

Recientemente, la Agencia de Asistencia Jur\u00eddica (LAA) consider\u00f3 que una mujer no ten\u00eda derecho a asistencia jur\u00eddica tras alegar que no ten\u00eda personas a su cargo porque su hijo no viv\u00eda con ella. Una mujer y su expareja, que la maltrataba, hab\u00edan acordado un r\u00e9gimen de visitas a su hijo; sin embargo, la expareja incumpli\u00f3 su acuerdo y limit\u00f3 el contacto de la mujer con su hijo.<\/p>\n\n\n\n

En un intento de tener m\u00e1s acceso a su hijo, solicit\u00f3 asistencia jur\u00eddica para llevar el asunto a los tribunales con representaci\u00f3n letrada. El sitio LAA<\/a> determin\u00f3 que, dado que el hijo no resid\u00eda actualmente con ella, no pod\u00eda ser considerado como persona a su cargo. En consecuencia, su renta disponible superaba el umbral utilizado para determinar si una persona tiene derecho a la prestaci\u00f3n.<\/p>\n\n\n\n

C\u00f3mo se determina el derecho a la asistencia jur\u00eddica gratuita: Medios, m\u00e9ritos y personas a cargo<\/h2>\n\n\n\n

La asistencia jur\u00eddica gratuita ayuda a las personas <\/strong>que no disponen de medios para costearse la asistencia jur\u00eddica que solicitan. En los casos civiles, la cuant\u00eda de la ayuda financiera que recibe una persona la determina la LAA evaluando los medios y los m\u00e9ritos de esa persona. Los m\u00e9ritos en un caso se refieren a la probabilidad de \u00e9xito del individuo. Los medios en un caso se refieren a la situaci\u00f3n financiera de la persona en cuanto a ingresos y capital.<\/p>\n\n\n\n

Las personas a cargo tambi\u00e9n suelen incluirse en la evaluaci\u00f3n de la LAA de la elegibilidad de una persona para recibir ayuda financiera. Cuando la LAA eval\u00faa la renta disponible de una persona, elimina aproximadamente 307,64 \u00a3 por cada hijo a cargo.<\/p>\n\n\n\n

Impugnar una denegaci\u00f3n de justicia gratuita ante el Tribunal Supremo<\/h2>\n\n\n\n

Dada la inadecuada evaluaci\u00f3n de la situaci\u00f3n econ\u00f3mica de la mujer por parte de la LAA, \u00e9sta llev\u00f3 la decisi\u00f3n ante el Tribunal Superior, representada por el Proyecto de Derecho P\u00fablico, para que se revocara la decisi\u00f3n. La vista se celebr\u00f3 el 8 de marzo de 2023.<\/p>\n\n\n\n

El Tribunal Supremo anula la denegaci\u00f3n ilegal de asistencia letrada<\/h2>\n\n\n\n

En la vista, el Tribunal Superior anul\u00f3 la decisi\u00f3n de la LAA de denegar la asistencia jur\u00eddica al demandante. Se argument\u00f3 con \u00e9xito que la orientaci\u00f3n proporcionada por el Lord Canciller a la LAA era ilegal en la medida en que restringe la Agencia de Asistencia Jur\u00eddica<\/a> capacidad para ayudar a los padres en esta situaci\u00f3n. Tambi\u00e9n se argument\u00f3 con \u00e9xito que la LAA no hab\u00eda considerado por qu\u00e9 el ni\u00f1o no viv\u00eda con la madre. El Juez no concedi\u00f3 respecto al argumento final presentado sobre si se hab\u00edan violado los derechos de la demandante en virtud de los art\u00edculos 6 y 8 del Convenio Europeo de Derechos Humanos.<\/p>\n\n\n\n
